California Privacy Notice

Last updated: October 12, 2026

Notice at collection and California privacy rights.

This notice supplements the Privacy Policy for California residents. It is the notice at collection of Genawatt LLC and PES Action Corp under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”). Whether every CCPA duty applies depends on statutory thresholds, including revenue, the volume of personal information processed, and the share of revenue from selling personal information. These rights are provided as a practice for California customers of the rate-audit service even where a threshold is not met, except where a right exists only for a business that meets those thresholds.

1. Categories collected, and why

In the 12 months before this notice, and going forward, we collect the categories below. We collect them to perform the audit, take payment, secure the service, keep required records, and, for contact details, to tell you about related bill-reduction services.

CategoryExamples and purpose
IdentifiersName, email, phone, service address. To deliver the report, contact you, and prevent fraud.
Commercial informationOrder, fee election, payment status, report date. To perform and record the contract.
Customer records / utility usageAccount number, rate schedule, bill images, kWh history. To compare published schedules. This is the core of the audit.
Internet activityIP address, pages viewed, actions on the site, cookie and advertising identifiers. To run and secure the site, and to measure and improve our advertising through Google tags and, when enabled, a Meta pixel.
InferencesWhich published schedule appears to fit the usage in the bills. To write the report.
Sensitive personal informationWe do not seek government identifiers or precise location. A utility account number is treated as personal information. Send program documents only if the report instructions ask for them.

Sources are you, your uploaded bills, the payment processor used by PES Action Corp, and site logs. We retain each category as described in the Privacy Policy. We do not sell personal information for money. We use Google analytics and advertising tags and, when enabled, a Meta pixel, and sending identifiers and internet activity to them may be “sharing” for cross-context behavioral advertising under California law. Genawatt and PES disclose it to each other and to contracted service providers for the business purposes above. PES takes payment for the audit.

2. Rights

Opt out of the Google and Meta analytics and advertising tags on this site.

Your choice is saved in this browser and device only. Clearing site data resets it.

Subject to verification and to exceptions in the CCPA, a California resident may:

  • Know the categories and specific pieces of personal information we collected about them, the sources, the purposes, and the categories of recipients.
  • Correct inaccurate personal information.
  • Delete personal information, subject to exceptions for completing a transaction, security, compliance, and internal uses reasonably aligned with your expectations.
  • Opt out of sale or sharing. Use the control above, which also honors the Global Privacy Control signal from your browser, or send an email to info@genawatt.com with the subject line: “Do Not Sell or Share My Personal Information” and we will update your preferences.
  • Limit use of sensitive personal information to what is necessary to perform the services. We do not use sensitive personal information for other purposes.
  • Not receive discriminatory treatment for exercising these rights.
  • Appeal a denial, by replying to our decision email with the word “Appeal.”

Only you, or a person registered with the California Secretary of State whom you authorize, may make a request. We will verify a request by matching name, email, phone, and, if needed, a detail from the order or bill you already provided. We will not ask you to send a new full bill solely to verify a privacy request. An authorized agent must provide signed permission and we may still confirm with you.

Submit requests to info@genawatt.com or 760.585.7000. We will acknowledge and respond within the CCPA timeframes, generally 45 days, with one permitted extension of 45 days if we tell you why.

3. Notice at collection

Genawatt LLC collects your name, email, phone, and utility bills to offer the rate audit. PES Action Corp (Premier Energy Strategies) performs the analysis and takes payment. Genawatt keeps your contact information to offer related bill-reduction services. We do not sell your information. We use Google advertising tags and, when enabled, a Meta pixel, and you can opt out of sharing through the footer link. The fee, paid to PES Action Corp, is $97, or 50% of projected two-year savings (your monthly bill × 24 months × 7%, up to $500), as you elect. The full terms are the Terms of Service and the Privacy Policy. California residents can request access or deletion at info@genawatt.com or 760.585.7000.

4. Financial incentive

The choice between a $97 fee and a Performance fee is a price for the audit, not a financial incentive offered in exchange for personal information. You may use the Service only if you provide the bills needed to perform it.
