Privacy Policy

Last updated: October 12, 2026

This policy describes how Genawatt LLC and PES Action Corp, each at 3141 Tiger Run Court, Suite 102, Carlsbad, California 92010, collect, use, and share personal information when you visit the site, request a rate audit, or communicate with us. Genawatt operates the site. PES performs the audit and takes payment. It applies to information collected online and to bills and account details you send for an audit. It does not apply to your utility.

1. Information we collect

  • Identifiers and contact information: name, email, phone, service address, billing address, and customer-support correspondence.
  • Utility and usage information: account name and number, meter or service agreement identifiers, rate schedule, billing history, kWh and demand if shown, charges, community choice aggregator if shown, and images or PDFs of bills you upload.
  • Commercial information: the audit ordered, the fee elected, payment status, and the report delivered. Payment-card numbers are collected and stored by our payment processor, not by us.
  • Internet and device information: IP address, browser type, pages viewed, and approximate location derived from IP, collected by cookies and similar tools, including Google analytics and advertising tags and, when enabled, a Meta (Facebook) pixel, which also record what you do on the site, such as viewing pages or submitting a form.
  • Inferences: our conclusion about which published rate schedule appears to fit the usage pattern in the bills you provided.

We do not ask for government identifiers or precise GPS location. Send only the bills and account information needed for the review, plus any program documents the report instructions ask for. We do not knowingly collect information from children under 16. The Service is for adults.

We collect this information from you, from the bills you upload, from your utility documents, from payment and hosting vendors, and from cookies on our site.

2. How we use information

  • To perform the audit, prepare the report and instructions, take payment, and provide customer service.
  • To verify identity and reduce fraud, especially where a billing address and service address differ.
  • To keep records of the engagement and to meet recordkeeping duties.
  • To send service messages about an order you placed.
  • To offer additional bill-reduction services by email, and by text only if you opt in. You may opt out at any time.
  • To maintain, secure, and understand use of the website.
  • To measure and improve our advertising, including through Google tags and, when enabled, a Meta pixel.
  • To comply with law and to establish or defend a claim.

We do not use utility-bill contents to make automated decisions that by themselves change your account. The fee follows the formula in the Terms and the election you make.

3. How we share information

Genawatt and PES share personal information as follows:

  • Between Genawatt LLC and PES Action Corp, so PES can perform the audit, prepare the report, and take payment, and so Genawatt can operate the site and offer later bill-reduction services.
  • Payment, hosting, cloud-storage, email, text-message, and customer-support vendors, bound by contract to use the information only to provide services to us.
  • Professional advisors and authorities, when required by law or to protect rights, safety, and the security of the Service.
  • A buyer of the business, if we are involved in a merger, financing, or sale of assets, under confidentiality terms.

We do not sell personal information for money. We use Google Analytics and advertising tags on the site and, when enabled, a Meta (Facebook) pixel. These tags send information such as your IP address, device and cookie identifiers, pages viewed, and actions you take on the site to Google and, when enabled, Meta. Under California law this may be “sharing” personal information for cross-context behavioral advertising. You can opt out by using the “Do Not Sell or Share My Personal Information” link in the site footer, or by enabling the Global Privacy Control signal in your browser. See the California Privacy Notice.

We may disclose aggregated or de-identified information that cannot reasonably be used to identify you. We will not try to re-identify it except to test the de-identification.

4. Retention

We keep contact information and audit records for as long as needed to provide the Service, offer the additional services described above, and meet recordkeeping and dispute-resolution needs. Utility-bill files and reports are kept for up to four (4) years after the report is delivered, unless a longer period is required for a payment dispute or a required record. Marketing contact details are kept until you opt out or request deletion, subject to records we must retain. Payment records are kept as our processor’s rules require.

5. Security

We use administrative, technical, and organizational measures appropriate to the information, including encryption in transit for site forms and restricted access to bill files. Uploaded bills are stored in the company’s Microsoft cloud storage (SharePoint or OneDrive), and access is restricted to company employees. No method of transmission or storage is completely secure. Do not send utility passwords. Email a bill only if you accept the risk of ordinary email, or use the upload method on the site when one is offered.

6. Your choices

  • Marketing email: email info@genawatt.com and we will stop.
  • Texts: reply STOP to a program message. See the Mobile Message Terms.
  • Advertising tags and cookies: use the “Do Not Sell or Share My Personal Information” link in the site footer, or your browser controls. Necessary cookies that run the site and checkout may remain.
  • California rights: see the California Privacy Notice. Submit a request to info@genawatt.com or 760.585.7000.

We will not discriminate against you for exercising privacy rights. We may still charge the agreed fee for an audit already delivered, and we may decline a new order if we no longer have the information needed to perform it.

7. Changes and contact

We may update this policy by posting a new version with a new date. A material change to how we use contact information for marketing will be noted on the site or by email if we have your address. Contact the privacy desk at 3141 Tiger Run Court, Suite 102, Carlsbad, California 92010, info@genawatt.com, 760.585.7000. Payment questions may be directed to PES Action Corp at the same address.
